Hi. :(

My QP was smashed driver's side, both doors, estimated to be between about $33K damage, but the responsible party's insurance is starting to hassle me about the claim.

The accident happened in WV, but her insurance company's adjustor agreed to and even outright recommended shipment to a specialist in PA (Karosserie). Now the claim has been transferred to an adjustor in that area to handle, and he is wanting to cut corners, and won't accept nor even negotiate with the shop on their estimate.

I need a good reference for a powerful attorney. It would be best if in PA or WV, and also having prior experience with insurance related problems.

Might anyone here have good ideas?

Tell them you are having headaches from the accident and if this is not taken care of you are all going to the Mayo clinc for cat scans. I bet they can not get you the check fast enough. I have used that one in the past.
They drove the check over to me.

Generally speaking, the law requires insurance companies to provide for repairs that restore the vehicle to the condition it was in prior to the wreck, if not better.

In any event, I would check the law in your state, since each state is different - then tell the adjuster that if they don't start playing fair & equitably, you're going to be forced to file complaints with the state board of insurance (or whatever it's called there - I'm referring to whatever agency regulates insurance companies in your particular state), as well as the state Attorney General. Document everything, don't just call & bitch... have a list. Remind the insurance company what a hassle it's going to be for them if this claim goes to arbitration & even more so if the AG finds enough evidence to open up an investigation on them. See if that might get 'em moving in the right direction.

Then if that doesn't work, then you can spend the money for an attorney.

And in all seriousness, you should get checked also. A lot of times people sustain injuries from collisions that do not present immediately, which not only could mitigate your recovery but make it difficult to make a claim. If 33K worth of damages was done to the driver's side, you must have been exposed to some pretty good side-load G forces, which can cause sloshing of the brain, vascular damage, and spinal trauma. Example- Did your head hit the driver's side window?

Firstly, Karosserie is EXCELLENT..... they repainted my front end under warranty.... superb work.

Secondly, James J Binns, extremely tough lawyer..... his name can spark a settlement..... Philadelphia .

Bypass this inspector - go to his supervisor or the person in charge of claims in that region. Advise them that you will not deal with that adjuster based on how you have been treated and that you would like this to be resolved quickly and amicably but if not resolved in the next week you will be turning the matter over to your lawyers - then send it in writing overnight or fax.
